CONSTRUCTION LITIGATION

The OBT construction law practice group assists clients with resolution of legal issues in the design and construction of industrial, marine, commercial, public works, heavy civil construction and residential projects.  OBT’s construction lawyers negotiate, draft and review contract documents for a variety of procurement methods, including design-build, construction management, competitive bid and negotiated work.  During the performance of a project, our lawyers assist clients with bid disputes, contractor default, delay and disruption to the schedule, owner default and owner-caused delay, force majeure, changes in site conditions, mechanics and materialman’s liens, defective work issues, defective design issues, property and casualty losses, state and federal regulatory issues, the change order process including extra work claims, scope of work claims, termination issues, performance bond and completion issues, payment bond claims, liquidated damages claims and warranty claims.  If disputes arise that cannot be resolved, OBT has extensive experience with mediation, arbitration and litigation of claims.  The OBT construction law practice group includes attorneys that are members of the Forum Committee on the Construction Industry of the American Bar Association; the Construction Committee of the Litigation Section of the American Bar Association; Construction Law Section of the State Bar of Texas and the Construction Section of the Houston Bar Association.  Practice group members are frequent lecturers to industry groups and frequent authors of articles in construction related bar journals and industry publications.
