David
has jury trial experience in a broad range of litigation throughout
East Texas and Southeast Texas courts. He has received favorable trial
verdicts as lead counsel in Hardin, Jasper, Jefferson, Liberty,
Newton, Orange, Polk, Sabine, and San Augustine counties, as well as
the federal courts in the Eastern District of Texas. He has also
handled and resolved litigation in Angelina, Dallas, Galveston,
Harris, Nacogdoches, Shelby, Travis, and Tyler counties, as well as
the federal courts in the Southern District of Texas.
His jury trial experience includes cases involving catastrophic
torts, personal injury and business disputes on both sides of the
docket. His jury and non-jury trial experience also includes business
disputes, breach of contract, tortious interference with contract,
fraud, wrongful foreclosure, oil and gas royalties, defense of civil
rights claims, municipal liability, deceptive trade practices,
conversion, malicious prosecution, premises liability, workers
compensation, and wrongful termination claims.
David is Board Certified by the Texas Board of Legal Specialization
in Personal Injury Trial Law. In 2004, Texas Monthly recognized David
as a Texas Rising Star. In both 2004 and 2005, Texas Monthly
recognized him as a Texas Super Lawyer.
David has also served as trial or appellate counsel in 14 appellate
opinions in the Texas Supreme Court, several courts of appeals, and
the Federal Fifth Circuit. Significant cases include Torrington v.
Stutzman, 46 S.W.3d 829 (Tex. 2000), Texas Beef Cattle Co. v. Green,
921 S.W.2d 203 (Tex. 1996), Simpson v. Hines, 903 F.2d 400 (5th Cir.
1990), and Etie v. Walsh & Albert, 135 S.W.3d 764 (Tex.
App.-Houston [1st Dist.] 2004, pet. denied).
In February 2005, David presented a seminar paper for the Jefferson
County Bar Association Personal Injury Seminar entitled,
"Caution-Danger-Lawyers Beware! Improper Handling of Charge Can
Explode in Your Face."
David is admitted to practice law in the state of Texas, the
Federal District Courts for the Eastern and Southern Districts of
Texas, and the Fifth Circuit Court of Appeals.
David is a member of the Texas Association of Defense Counsel and
an associate member of the Texas Trial Lawyers' Association. He has
served as the President of the Jefferson County Young Lawyers
Association.
David graduated from Southwestern University in 1985 and from Texas
Tech University School of Law in 1988. While at Texas Tech, he served
as the Chairman of the Board of Barristers.
David is married and the father of four children. He actively
participates in church activities as a teacher. He is licensed as a
minister through Worldwide Missions Fellowship and Fletcher Emanuel
Church Alive in Lumberton, Texas. He served as the President of the
Silsbee Kiwanis Club and currently serves as the Vice-President of the
Silsbee Chamber of Commerce.
David practices primarily in the firm's office in Silsbee.
