Robert J. Hambright has defended over three hundred cases in the
state and federal courts involving all aspects of labor and
employment law. He has tried many of these cases to verdict or
judgment. However, he has also obtained summary disposition of
numerous cases and has negotiated successful settlements of many
more.
Robert is Board Certified in Labor and Employment Law by the Texas
Board of Legal Specialization. His primary practice area is
representing employers in labor and employment law matters,
particularly litigation. He has represented employers in all types
of labor and employment law litigation including issues such as
discrimination, harassment and retaliation under Title VII, the ADA
and similar federal and state statutes, wage and hour cases under
the FLSA, benefit cases under ERISA, leave cases under FMLA,
non-competition agreements, and others too numerous to list here.
Some of the cases in which he has represented employers and other
defendants have resulted in reported court opinions, as shown
in
appendix A.
Robert routinely defends employers in discrimination charges before
the Equal Employment Opportunity Commission (EEOC) and the Texas
Workforce Commission (TWC), handles cases before the National Labor
Relations Board (NLRB) and the Department of Labor (DOL), assists
with collective bargaining negotiations and tries arbitration cases.
He also advises employers on litigation avoidance and prepares a
full range of labor and employment policies and documents.
Since 1986, Robert has been listed every year in the national
reference book, The Best Lawyers in America, under the category of
Labor and Employment Law. He has been selected as a Texas Super
Lawyer in the field of Employment Litigation by Texas Monthly each
year since 2003.
Robert is a published author of articles on labor and employment law
subjects, and most recently he authored the chapter on the federal
ERISA statute for the Employment Law Handbook published by the Texas
Association of Business and Chambers of Commerce.
Robert served as Chairman of the 500-member Labor and Employment Law
Section of the State Bar of Texas from 1986-1987. He is currently
serving as the Vice President for Legislative Action for the
Montgomery County Society for Human Resource Management.
Robert is admitted to practice before the U.S. District Court for
the Eastern District of Texas, the U.S. District Court for the
Southern District of Texas, the U.S. Court of Appeals for the Fifth
Circuit, the U.S. Supreme Court, and the U.S. Tax Court.
Robert is a Life Fellow in the Texas Bar Foundation. He is also a
member of the Rotary Club of Beaumont, and is a life member of the
national Eagle Scout Association of the Boy Scouts of America.
