Probate and Estate, Trust and Guardianship Administration
We handle a wide variety of probate and estate administration
matters, including guardianships for minors and incapacitated
adults, and we advise executors, trustees, guardians, and
beneficiaries of trusts and estates on all aspects of estate, trust,
and guardianship administration.
We regularly appear before the county court and probate court
judges throughout Southeast and East and Southeast Texas in
connection with applications to probate wills. We also assist
clients in heirship proceedings and the appointment of estate
administrators in cases of death with no last will and testament.
Estate administration frequently involves dealing with the claims
of creditors, and our attorneys are experienced in responding to
these claims on the client's behalf, ensuring that the protections
afforded to surviving family members under the Probate Code are
enforced.
Our attorneys also represent clients in connection with will
contests and other contested estate and trust matters, and we have
been successful in negotiating family settlement agreements between
disputing family members.
In the area of guardianships, we assist guardians with all phases
of the guardianship process, from the initial application and
determination of incapacity, to the preparation of annual accounts
and reports required under the Probate Code, to the closing of the
guardianship following the ward's death, attainment of majority, or
restoration of capacity. We also assist clients with the transfer of
guardianships from other jurisdictions and the creation of various
types of management trusts for the benefit of minors and
incapacitated persons. Members of the Probate and Estate, Trust and Guardianship
